[3]   abstract education right is of primary human rights that is free from time, space, and issues like gender, language, ethnicity, religion that should be provided to all until their death. in islamic law, education right is meant being emphasized by quran, narrations and anecdotes of imams. it does not contradict with the obligatory nature of universal education according to human rights laws that should be followed by the governments in support of education and its continuation resulting in sublimity and growth of the society. jurisprudence perspectives indicate that educational right and training are the principal duties of families and governments at any age. in fact, it is the knowledge and enlightment that distinguishes humans from others that the passed statutory laws are maintaining empatically the observance of such primary rights through the international human laws. still there does not exist any guarantee for their implementation. it demands universal and obligatory attempts efforts. key words: right, education, education right, human rights, islamic law.
